Terms of service

These Terms of Service ("Terms") govern your use of products provided by PoseCap Inc. ("we", "us"): PoseCap, PoseCoach, and Pose CLI. By using any of these products you agree to these Terms. If you do not agree, do not use the products.

1. Eligibility

PoseCap and PoseCoach are intended for users above the age of 4. Pose CLI is intended for users above the age of 13. By using a product you affirm that you meet the relevant age requirement.

2. Permissions

To deliver core functionality you grant the relevant product the device permissions it requests (camera, microphone, motion, Apple Watch). Captured media and motion data are stored on your device or in the Pose CLI instance you use, as described in our Privacy Policy.

3. Intellectual property

3.1 Our products

The products, including all content, features and functionality, are owned by PoseCap Inc. and protected by intellectual property laws. You may not copy, modify, distribute, sublicense or reverse engineer any part of the products except as expressly permitted by us or applicable law.

3.2 Your content

You retain ownership of media, sessions, and analysis outputs you create with our products. By using a product you grant PoseCap Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute such content solely for the purpose of operating, supporting and improving the products.

4. Acceptable use

• You will not use the products to violate the rights of others, including filming or recording without consent where required by law.
• You will not attempt to disrupt, reverse engineer, or circumvent technical measures of the products.
• You will not use the products to build a competing service without our written consent.

5. Beta and early access disclaimers

PoseCoach is currently distributed via TestFlight as a public beta. Pose CLI is currently available under early access. Beta and early-access software may contain bugs, change without notice, and is provided without warranty.

6. Disclaimers and limitation of liability

The products are provided "as is" and "as available". To the maximum extent permitted by law, PoseCap Inc. disclaims all warranties, express or implied. We are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or business opportunities, arising from your use of or inability to use the products.

7. Indemnification

You agree to indemnify and hold PoseCap Inc., its affiliates, officers and employees harmless from any claims, damages, liabilities or expenses arising from your violation of these Terms or your use of the products.

8. Termination

We may suspend or terminate your access to a product if you violate these Terms or if we reasonably believe doing so is necessary to protect users or the integrity of the product.

9. Changes to these Terms

We may update these Terms from time to time. The current version will be posted on this page. Continued use of the products after a change constitutes acceptance of the revised Terms.

10. Governing law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflicts of laws principles.
